This End User License Agreement (“Agreement”) is a binding legal agreement between you (“you,” “your,” or “Customer”) and PeepSo, Inc., a Delaware corporation (“PeepSo, Inc.,” “SwipeWP,” “Swipe,” “we,” “us,” or “our”), governing your purchase, download, installation, activation, access to, and use of software, updates, license keys, downloads, documentation, support, and related services made available through https://SwipeWP.com.
By purchasing, downloading, installing, activating, accessing, or using SwipeWP products or services, you confirm that you have read, understood, and agreed to be bound by this Agreement, as well as our Terms and Conditions, Privacy Policy, Refund Policy, and Support Policy, all of which are incorporated by reference to the extent applicable.
If you do not agree, do not purchase, install, download, access, or use our products or services.
1. Nature of the Software
SwipeWP products are software products intended for use with WordPress and related environments. Certain parts of the software may be distributed under open-source license terms, while other parts, rights, services, branding, support entitlements, or commercial access rights may be governed separately by this Agreement and other applicable policies.
Nothing in this Agreement is intended to limit rights that cannot legally be limited under the applicable open-source license governing any particular component. At the same time, nothing in the GPL or any other open-source license grants you rights to our trademarks, branding, support, hosted services, account access, updates, license key infrastructure, billing privileges, or commercial relationship with us.
2. PHP Code – GPL License
Unless expressly stated otherwise in the relevant files, the PHP code of SwipeWP plugins and themes produced by PeepSo, Inc. is licensed under the GNU General Public License, version 2 or later.
You may redistribute and/or modify covered GPL code under the terms of that license.
That GPL-licensed code is distributed in the hope that it will be useful, but without any warranty, to the fullest extent permitted by law. For more information, see the GNU GPL license text.
3. Other Components, Assets, and Materials
Except to the extent a specific file or component is expressly licensed otherwise, all rights in and to the following remain reserved by PeepSo, Inc. and/or its licensors:
- trademarks;
- logos;
- brand names;
- product names;
- slogans;
- trade dress;
- website content;
- copywriting;
- documentation;
- sales materials;
- marketing materials;
- videos;
- screenshots;
- graphics;
- iconography;
- account systems;
- license key systems;
- support systems;
- billing systems;
- hosted update infrastructure;
- customer dashboards;
- non-code content;
- any proprietary materials not expressly released under an open-source license.
Where CSS, JavaScript, images, fonts, design elements, or other assets are included with a product, their licensing status is determined by the license notice accompanying those files or packages, if any, and by applicable law. Nothing in this Agreement should be interpreted to grant broader rights than those expressly provided.
Unauthorized copying, misrepresentation, resale, sublicensing, rebranding with our marks, or commercial exploitation of protected non-GPL materials is prohibited.
4. Trademarks and Branding
SwipeWP, Swipe, related logos, slogans, visual branding, and other brand identifiers are trademarks, service marks, trade names, or trade dress of PeepSo, Inc., whether registered or unregistered.
Open-source licensing of code does not grant you any right to use our trademarks, product names, logos, branding, slogans, or confusingly similar identifiers.
If you redistribute, fork, modify, or republish code in a way that would create confusion as to source, sponsorship, endorsement, affiliation, or origin, you must remove or replace SwipeWP / Swipe branding and any other protected brand identifiers unless you have our prior written permission.
You may not represent your fork, modified version, derivative distribution, service, or website as an official SwipeWP product or as endorsed by PeepSo, Inc. unless we have expressly agreed in writing.
5. Infringement and Brand Abuse
If we reasonably believe that you have engaged in copyright infringement, trademark infringement, unauthorized redistribution, brand misuse, piracy, license circumvention, deceptive resale, or similar misuse relating to SwipeWP products, PeepSo, Inc. may, in its sole discretion and without prior notice:
- suspend or terminate your account;
- revoke access to downloads;
- disable or revoke license keys;
- terminate support access;
- block future purchases;
- deny refunds;
- preserve and disclose records where reasonably necessary to protect our rights.
These remedies are cumulative and in addition to any other rights or remedies available at law or in equity.
6. Commercial License Keys and Account Entitlements
Your purchase may include a commercial license key, subscription, account entitlement, or activation allowance. These commercial entitlements are not the same thing as the open-source license on any GPL-covered code.
A commercial license key may control access to:
- downloads;
- updates;
- upgrades;
- account features;
- supported domain assignment;
- license management tools;
- activation-controlled functionality;
- support eligibility;
- hosted services;
- other customer-only benefits.
License key access exists only for the duration and scope of the purchased plan.
7. Usage Terms
Your purchased license variation determines, among other things:
- the number of websites or domains eligible for activation;
- access to updates and downloads;
- access to technical support;
- subscription duration;
- renewal terms;
- availability of hosted or activation-based features.
You may use SwipeWP only in accordance with the scope of the license you purchased and all applicable policies.
Use outside the permitted scope, including excessive activation, unauthorized key sharing, resale, sublicensing, account sharing, or circumvention of license limits, is prohibited.
8. Technical Support
Technical support is not included forever and is not included for everyone.
Access to support is governed by our Support Policy and is generally available only to customers with valid, active, paid licenses in good standing, for the number of sites covered by the purchased plan.
Expired, suspended, revoked, refunded, disputed, or otherwise invalid licenses are not entitled to technical support.
Free products, if any, may be supported only through documentation, videos, community content, or other public materials, unless we state otherwise.
9. Downloads, Updates, and Upgrades
You have access to downloads, updates, upgrades, and license-managed benefits only while you have a valid active license or subscription covering those entitlements.
When your license expires, is cancelled, is refunded, is disputed, or is revoked, you may lose access to some or all of the following:
- downloads;
- updates;
- upgrades;
- support;
- account features;
- domain reassignment tools;
- activation-managed functionality;
- customer-only resources.
For clarity, expiration of a commercial license does not retroactively erase rights you may have under an applicable GPL license to code you already lawfully received, but it does end your contractual entitlement to ongoing commercial services, support, updates, download access, and license-managed benefits unless required otherwise by law.
10. Expired Licenses
Once your commercial license expires, you will no longer have access to future downloads, technical support, updates, upgrades, and license management functions tied to that license unless you renew or purchase a new entitlement.
You may also be unable to add, remove, or change domains assigned to the license key.
If SwipeWP products rely on activation, hosted validation, account services, or license-managed systems for certain features or continuing operation, those features may stop working or may be limited after license expiry, suspension, or revocation.
We reserve the right to modify how our licensing systems handle expired licenses, including grace periods, feature limitations, reactivation requirements, or service discontinuation, in our sole discretion.
11. Non-Transferability of Commercial Entitlements
All purchased account entitlements, commercial license keys, subscriptions, and support rights are bound to the original purchasing account unless we expressly approve a transfer in writing.
They are non-transferable by default.
Any attempted sale, transfer, assignment, sharing, sublicensing, or reallocation of commercial entitlements without our written approval may result in suspension or revocation.
For clarity, this section governs your contractual relationship with PeepSo, Inc. and the commercial entitlements attached to your account. It does not purport to override any rights that may arise under a separate open-source license applicable to any code component.
12. Modification of Software
To the extent permitted by the applicable open-source license, you may modify covered code.
However, we do not provide support for modified, hacked, patched, nulled, decompiled, pirated, or otherwise altered installations beyond our supported scope.
If you request support, we may require you to revert to a clean, unmodified version before we assist.
If you intend to customize the software, we strongly recommend using supported hooks, filters, overrides, child themes, and extension methods where applicable, rather than editing core files directly.
13. No Rights in Hosted Services or Infrastructure
Your purchase of a SwipeWP product does not grant you ownership of, or rights to copy, clone, reverse engineer, interfere with, or replicate, any of our hosted systems, update delivery mechanisms, license validation systems, customer systems, internal APIs, billing infrastructure, or support infrastructure, except to the limited extent permitted by applicable law.
We reserve the right to modify, suspend, replace, or discontinue hosted or account-based systems at any time.
14. Restrictions
You agree not to, and not to assist others to:
- misuse or share license keys outside the licensed scope;
- resell, rent, sublicense, lease, or commercially exploit account-only entitlements without permission;
- remove or falsify copyright, attribution, trademark, or ownership notices where not permitted;
- impersonate SwipeWP or PeepSo, Inc.;
- create confusion as to source or affiliation;
- use our trademarks without permission;
- bypass, disable, defeat, or tamper with licensing or account controls;
- use pirated or unauthorized copies;
- abuse support staff or support systems;
- use the software or services unlawfully or in violation of our policies.
15. Account Sanctions and Revocation
We reserve the right, in our sole discretion, to suspend or revoke access to SwipeWP.com, customer accounts, license keys, downloads, updates, hosted services, support, and related benefits for any person who:
- abuses our staff;
- abuses support or refund policies;
- engages in fraud;
- initiates bad-faith chargebacks or payment disputes;
- infringes intellectual property rights;
- misuses trademarks or branding;
- engages in piracy or unauthorized redistribution;
- violates this Agreement or any related policy;
- creates legal, operational, or security risk for us.
Such action may be taken with or without prior notice where we deem appropriate.
16. Ownership
Except for rights expressly granted under the applicable open-source license and this Agreement, all rights, title, and interest in and to SwipeWP products, services, branding, infrastructure, websites, documentation, and protected materials remain with PeepSo, Inc. and/or its licensors.
No implied license is granted.
17. No Warranty
To the maximum extent permitted by law, SwipeWP products, services, support, websites, updates, license systems, and all related materials are provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise.
This includes, without limitation, implied warranties of:
- merchantability;
- fitness for a particular purpose;
- non-infringement;
- title;
- compatibility;
- uninterrupted operation;
- error-free performance;
- security;
- availability.
We do not warrant that the software will meet your requirements, work in every environment, remain continuously available, or be free from bugs, vulnerabilities, incompatibilities, or interruptions.
18. Limitation of Liability
To the maximum extent permitted by law, PeepSo, Inc. shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, customers, goodwill, business opportunities, or business interruption arising out of or relating to the purchase, download, installation, access to, or use of SwipeWP products or services.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the product or service at issue shall not exceed the amount you actually paid to us for that specific product or service during the twelve months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain liability limitations, so parts of this section may not apply to you to the extent prohibited by law.
19. Refunds
Refund eligibility, if any, is governed exclusively by our Refund Policy.
Nothing in this Agreement creates a refund right beyond what is expressly stated in that policy or required by applicable law.
20. Policy Changes
We may change, revise, replace, suspend, or update this Agreement at any time in our sole discretion.
The version posted on the website at the time of your purchase or use will generally govern unless a newer version is required by law or expressly made applicable.
You are responsible for reviewing this Agreement periodically.
21. Severability
If any provision of this Agreement is held invalid, unenforceable, or limited under applicable law, that provision shall be interpreted as closely as possible to its intended purpose, and the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
